General Terms and Conditions (GTC) for ChefTreff partners and exhibitors

§ 1 General and scope of application
1.1 These General Terms and Conditions (“GTC”) apply to all contracts between Be Brave gUG (haftungsbeschränkt) (hereinafter “Organizer”) and its partners and exhibitors (hereinafter “Partners”) in the context of ChefTreff Events.
1.2 The Organizer is a non-profit entrepreneurial company (haftungsbeschränkt) dedicated to the promotion of education and upbringing as well as the promotion of education and vocational training.
1.3 These GTC apply exclusively. Conflicting or deviating terms and conditions of the Partner shall not be recognized unless the Organizer expressly agrees to their validity in writing.
1.4 Amendments and supplements to these GTC must be made in writing.
§ 2 Registration and conclusion of contract
2.1 Registration is made using the registration form provided by the organizer, subject to acceptance of these GTC. Registration is binding.
2.2 The contract is concluded by the signing of a written offer by both contracting parties. In addition to the registration form, the organizer shall prepare an individual offer to be signed by both parties.
2.3 Until the offer has been signed by both parties, the organizer is not bound by the registration and may reject it without giving reasons.
2.4 Registrations subject to conditions or reservations shall only be accepted if this has been expressly agreed in writing in the offer.
2.5 Special requests for places or positions will be considered as far as possible, but cannot be guaranteed. Allocation is based on the date of receipt of the application and signing of the contract.
2.6 The organizer is entitled to reject registrations without giving reasons.
§ 3 Partnership packages and services
3.1 Exhibition stands The organizer offers the following stand categories:
All-inclusive stands:
- Startup (1.5 sqm), Intro (4 sqm), General (9 sqm), Premium (18 sqm)
- Included: Set-up, back wall, standard furniture, power supply, cleaning before the event, lighting
Signature stand: from 25 sqm (stand-alone set-up)
Premium Lounge: 18 sqm (all-inclusive equipment)
Main Stage Loge: 25 sqm (all-inclusive equipment)
For self-built stands (Signature Stand), electricity, cleaning and lighting are included.
3.2 Speaking slots Speaking opportunities on the following stages:
- Main Stage
- Topic Stage
All speaking slots are 30 minutes long including moderation and Q&A by a moderator provided by the organizer. Panel discussions can be extended to 45 minutes by arrangement.
3.3 Masterclasses Partners can book 60-minute masterclasses with:
- Application tunnel (provided by the organizer)
- Q&A session included
- Standard seating
- Technical setup: Screen, laptop, connection for external computer, clicker, microphone if required
- Implementation on one of the two event days
3.4 Company Tours partners book 75-90 minute slots in themed tours:
- Slot time and coordination by the organizer
- Depending on planned route and schedule
- Individual organization of the time on site by the partner
3.5 Branding and activations
- In the case of branding measures booked via the organizer, the organizer is responsible for provision and production
- For activations not booked through the organizer, the organizer reserves the right to charge for additional expenses (cleaning, disposal)
3.6 Stage branding
- Organizer is responsible for stage production and installation of branding elements by arrangement
- The stage production includes: Stage, screen, sound & technology, seating, moderation by arrangement
- Organizer reserves the right to make adjustments as long as these do not significantly affect the stage quality
3.7 AI Hackathon Two partner categories:
- Challenge Partner: Own stand/meeting place, 15 minutes pitch time for Challenge
- Impulse Partner: 15 minutes pitch time for your own content
- Hackathon location outside the CCH
- Organizer reserves the right to design the area and assign participants
3.8 Additional services Depending on the package, additional services may be included:
- Access to subscriber data and lead scanning
- Participation in exclusive partner events (partner breakfasts)
- Logo placement on website and marketing materials
- VIP area access
3.9 The specific services, prices and specifications are set out in the respective offer and the contract confirmation.
3.10 All service descriptions are non-binding. We reserve the right to make changes to the program, speakers, event times and locations.
§ 4 Costs and terms of payment
4.1 The remuneration is based on the confirmed offer. All prices are subject to statutory value added tax.
4.2 The entire invoice amount is due in advance:
- If the contract is concluded three months or more before the event: payment term 30 days
- If the contract is concluded less than three months before the event: payment term 14 days
4.3 Additional services can be ordered separately via the trade fair store. These invoices are due 7 days after the event.
4.4 Orders for additional services placed after the specified order deadline will be subject to a 25% late delivery surcharge.
4.5 In the event of late payment, the organizer is entitled to charge interest on arrears at a rate of 9 percentage points above the prime rate. After the expiry of a reasonable period, the organizer is entitled to withdraw from the contract.
§ 5 Withdrawal and cancellation
5.1 The Partner has the right to withdraw from the contract. Withdrawal must be declared in writing and is only effective upon written confirmation by the organizer.
5.2 In the event of withdrawal, the following cancellation fees shall apply:
- up to 6 months before the start of the event: 50% of the agreed remuneration
- up to 3 months before the start of the event: 75% of the agreed remuneration
- thereafter: 100% of the agreed remuneration
5.3 The Partner has the right to prove that the Organizer has incurred no or significantly less damage.
5.4 The organizer is entitled to extraordinary withdrawal if:
- the partner is in arrears with payments
- insolvency proceedings are opened against the partner’s assets
- the partner breaches material contractual obligations
- the official permits required for the event have not been obtained
§ 6 Stand construction and technical equipment
6.1 Stand construction is generally carried out by the Organizer or by service providers commissioned by the Organizer.
6.2 Premium Partners may commission their own stand constructors. This requires the prior written approval of the organizer and the Congress Centrum Hamburg (CCH).
6.3 In-house productions are only possible after consultation and express approval by the Organizer and CCH. All necessary approvals must be obtained by the Partner at its own expense.
6.4 Technical connections (electricity, internet, etc.) must be ordered separately and will be charged at cost.
6.5 Changes to the allocated space or equipment require the written approval of the organizer.
§ 7 Sub-partners and joint stands
7.1 The transfer of the assigned area or parts thereof to third parties (sub-partners) requires the prior written consent of the Organizer.
7.2 Additional costs are incurred for each approved sub-partner. The main partner is liable for all costs and damages incurred by sub-partners.
7.3 In the case of unauthorized sub-partners, the organizer is entitled to terminate the contract without notice and have the area cleared at the partner’s expense.
§ 8 Subscriber data and lead scanning
8.1 If included in the partner package, the partner receives access to participant data for networking and marketing purposes.
8.2 The use of participant data is subject to the provisions of the GDPR. The Partner undertakes to use the data exclusively for the agreed purposes.
8.3 Lead scanning functions are provided via the event app. The technical details will be communicated separately.
8.4 The Partner may not pass on the data received to third parties or use it for purposes other than those agreed.
§ 9 Advertising and marketing
9.1 The Partner is entitled to advertise its participation in the ChefTreff event. The use of ChefTreff logos requires prior written approval.
9.2 The Organizer is entitled to use the Partner and its logo on the website, in marketing materials and in reporting.
9.3 All advertising measures of the Partner in connection with the event must be in accordance with common decency and must not violate statutory provisions.
9.4 The Partner shall indemnify the Organizer against all third-party claims arising from the infringement of copyrights, trademark rights or other property rights by the Partner’s advertising.
§ 10 Venue and domiciliary rights
10.1 The event shall take place at the Congress Centrum Hamburg (CCH). In addition to these GTC, the House Rules and the General Terms and Conditions for Events of the CCH shall apply.
10.2 The organizer exercises the house rules. In the event of violations of the house rules or these GTC, the partner may be excluded from further participation.
10.3 The Partner undertakes to staff its area with sufficiently qualified personnel during the opening hours of the event.
§ 11 Insurance and liability of the partner
11.1 The Partner is obliged to take out business liability insurance with a minimum cover of EUR 2 million for personal injury and property damage. Proof must be provided on request.
11.2 The Partner shall be responsible for insuring its own items and exhibits against all risks (transportation, theft, damage).
11.3 The Partner shall be liable for all damage caused by it, its employees or authorized third parties.
11.4 The Partner shall indemnify the Organizer against all third-party claims arising in connection with its participation.
§ 12 Liability of the organizer
12.1 The Organizer’s liability is limited to intent and gross negligence. In the event of slight negligence, the organizer shall only be liable for breach of essential contractual obligations (cardinal obligations).
12.2 In the event of a breach of cardinal obligations, liability shall be limited to the foreseeable damage typical of the contract.
12.3 The limitation of liability shall not apply in the event of injury to life, limb or health or in the event of a breach of guarantees.
12.4 The organizer is not liable for indirect damages, consequential damages and loss of profit, except in cases of intent or gross negligence.
12.5 Liability shall in any case be limited to the amount of the remuneration paid by the Partner.
§ 13 Force majeure and event cancellation
13.1 In the event of force majeure (natural disasters, pandemics, war, acts of terrorism, official orders, strikes), the organizer is entitled to cancel, postpone or reduce the scope of the event.
13.2 If the event is canceled in full, any amounts already paid will be refunded. In the event of postponement or reduced performance, a pro rata charge will be made.
13.3 Further claims of the Partner, in particular for damages, are excluded.
§ 14 Photo and video recordings
14.1 The organizer is entitled to take photographs and video recordings during the event and to use these for advertising, documentation and reporting purposes.
14.2 By concluding the contract, the Partner agrees to the production and use of such recordings.
§ 15 Data protection
15.1 The Organizer processes the Partner’s personal data for the purpose of contract performance and communication in the context of the event.
15.2 Further information on data processing can be found in the privacy policy at https://chef-treff.de/datenschutz.
§ Section 16 Lien
16.1 For all unfulfilled obligations, the Organizer has a right of lien and retention on the Partner’s items brought in.
16.2 In the event of default in payment, the items may be stored at the expense and risk of the partner and disposed of after written notice.
§ 17 Assembly and dismantling
17.1 Set-up shall take place at the times specified by the organizer. Early set-up requires approval.
17.2 Dismantling must take place within the specified dismantling times. Premature dismantling is not permitted.
17.3 A contractual penalty of 10-20% of the contract sum may be charged for breaches of the set-up and dismantling times.
17.4 Uncollected items shall be stored at the Partner’s expense.
§ 18 Warranty
18.1 Complaints regarding the services provided must be made in writing without delay, at the latest on the first day of the event.
18.2 The Organizer shall remedy justified defects as far as possible.
§ 19 Final provisions
19.1 Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions.
19.2 German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
19.3 The place of jurisdiction is Hamburg if the Partner is a merchant, a legal entity under public law or a special fund under public law.
19.4 All claims shall lapse within one year of the end of the event.
